Terms of Service
Effective July 30, 2026. Please read these Terms before creating an account or starting a trial.
1. Operator and Service
These Terms are an agreement between you and StoicForge LLC, operating as ATIYO ("ATIYO", "we", "us", or "our"). ATIYO is a creative-strategy platform for ecommerce brands and creators. It lets teams plan, brief, organize, review, and learn from advertising creative through a web application at atiyo.io.
2. Accounts
You must create an account to use ATIYO. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@atiyo.io if you suspect unauthorised access.
You must provide accurate account and billing information, including a reachable mobile phone number for new owner-created trials. You must be at least 18 years old and have the legal authority to accept these Terms for yourself or the organisation you represent.
3. Free Trial and Paid Subscription
New owner-created workspaces receive a 7-day free trial without providing a payment method. The trial begins when the workspace is created and ends at the time shown in ATIYO.
ATIYO does not automatically charge you when a cardless trial ends. To continue using paid features, an Admin must choose a plan, review its price and renewal terms, and complete secure card setup through Airwallex. ATIYO does not receive or store your full card number or card security code.
Starter is $29.99 USD per month or $299 per year; Growth is $79.99 per month or $799 per year; and Team is $149.99 per month or $1,499 per year, plus applicable taxes. The plan, billing interval, and price shown during checkout control if they differ from this summary. ATIYO-owned company workspaces, historical plans, and previously granted arrangements may have separate non-public entitlements.
If you attend a scheduled ATIYO onboarding call, ATIYO may manually extend your trial. An extension changes the displayed first-charge date but does not remove the payment-method requirement or change the selected renewal price.
4. Cancellation, Failed Payments, and Refunds
You may cancel from Settings → Billing or by contacting hello@atiyo.io. Cancel before the displayed trial deadline to avoid the first charge. After a paid period begins, cancellation stops future renewal and access continues through the paid period unless the checkout disclosure or applicable law says otherwise.
If a payment fails, ATIYO may provide a limited grace period and then lock workspace access until billing is resolved. Your saved work is not immediately deleted when access locks. Payments are non-refundable except where required by law or expressly stated otherwise at checkout.
5. SMS and Electronic Communications
Providing a phone number does not by itself opt you into promotional SMS. If you separately opt in, ATIYO may send onboarding help, trial reminders, product information, or promotional messages. Message frequency varies and message and data rates may apply. Reply STOP to unsubscribe or HELP for help. SMS consent is not a condition of purchase. See the SMS Terms and Privacy Policy.
You agree that ATIYO may send service-related electronic communications reasonably necessary to administer your account, subscription, team invitations, support requests, or booked demos, subject to applicable law.
6. Acceptable Use
You agree not to use ATIYO to:
- Upload, store, or share content that is unlawful, defamatory, infringing, or harmful;
- Attempt to gain unauthorised access to any part of the service or another user's account;
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the platform;
- Use the service in a way that degrades performance or availability for other users;
- Resell or sublicense access to ATIYO without our written permission.
We reserve the right to suspend or terminate accounts that violate these rules.
7. Intellectual Property
ATIYO and its underlying technology, design, and software are owned by StoicForge LLC and its licensors. Nothing in these Terms transfers ownership of the platform to you.
All trademarks, logos, and service marks displayed on ATIYO are the property of their respective owners. You may not use them without prior written consent.
8. Your Content
You retain full ownership of all content you upload to ATIYO — including creative briefs, notes, files, and any other workspace data (collectively, "Your Content"). By using ATIYO you grant us a limited, non-exclusive licence to store and process Your Content solely to provide the service to you.
We do not claim ownership of Your Content and will not use it for any purpose other than operating the platform.
9. Termination and Data Export
You may close your account at any time by contacting hello@atiyo.io. You may request an export of Your Content in a reasonably available standard format.
We may suspend or terminate your account for breach of these Terms, non-payment, or at our discretion with 30 days' notice. On termination, Your Content will be deleted from our systems within 90 days, except where retention is required by law.
10. Service Availability and Disclaimers
ATIYO is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee uninterrupted availability, a particular advertising result, or that recommendations from ATIYO or the bring-your-own-key ATIYO Brain will be complete or correct. You remain responsible for creative, advertising, business, and legal decisions.
11. Limitation of Liability
To the maximum extent permitted by applicable law, ATIYO and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business — arising from your use of or inability to use the service.
Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid to ATIYO in the twelve months preceding the claim.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version on this page and update the "Last updated" date above. Where required by law, we will provide additional notice or request renewed acceptance. Continued use of ATIYO after the effective date constitutes acceptance of the updated Terms.
